Terms of Service

1. Agreement to Terms

By accessing or using Photta ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Photta is an AI-powered SaaS platform that provides virtual fashion photography, product visualization, and AI-generated content creation services.

2. Subscription Plans and Pricing

Photta offers the following monthly subscription plans:

New users receive 20 free credits upon registration, valid for 30 days.

3. Credits

Credits are deducted before a generation starts and returned automatically if it fails. Subscription credits expire at the end of each billing period; credits bought as a one-off pack do not expire.

The credit cost of each feature is published on our credits page and forms part of these Terms. It is generated from the same system that charges them, so what is shown is what is taken. We may change these costs; the page always reflects the current figures.

4. Subscription Management

Subscriptions auto-renew monthly. You may cancel anytime and retain access until period end. Unused subscription credits do not roll over.

5. Rights in AI-Generated Content

You may use the images and videos you generate commercially, including after your subscription ends, with no attribution required. We assign to you whatever rights in that output we are able to assign under applicable law and under the terms of the AI providers we use. We do not warrant that AI-generated output attracts copyright protection, nor that your output is unique: the same inputs may produce similar results for other customers. You may not resell our models, poses or backgrounds as standalone stock assets, and you may not use output to train a competing AI model.

6. Refund Policy

All sales are final. Refunds may be granted on a case-by-case basis for technical errors, billing mistakes, or service outages exceeding 48 hours. See our Refund Policy for details.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS". WE DO NOT GUARANTEE UNINTERRUPTED SERVICE OR SPECIFIC AI RESULTS. Our total liability for any claim is limited to the amounts you paid us in the twelve (12) months before the event giving rise to it, and we are not liable for indirect or consequential loss, including lost profits, lost sales, advertising spend, or reputational harm. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury, fraud, or rights you have as a consumer.

8. Your Content and the Permissions You Need

You are responsible for everything you upload. By uploading, you confirm that you own the necessary rights or have obtained them, and that you have the consent of any identifiable person appearing in the image. You must not upload photographs of a person without their permission, images of children in any context that is not plainly appropriate, or content you intend to present as depicting a real person, brand or endorsement that it does not depict. If you are uploading on behalf of a business, you confirm you are authorised to do so.

9. Prohibited Uses

You may not use Photta to create, and we will remove and may terminate accounts for:

• Sexual, suggestive or otherwise inappropriate depictions of minors, or content that sexualises a person who appears to be a minor.
• Images of an identifiable person produced without that person's permission, including intimate or undergarment imagery.
• Content that impersonates a real person, public figure or brand, or that fabricates an endorsement.
• Content that infringes another party's copyright, trade mark or design rights, including reusing another brand's catalogue photography.
• Content that is unlawful, harassing, hateful, or that facilitates fraud or deception.
• Any attempt to bypass our safety controls, scrape the Service, or reverse engineer our models.

10. AI Output: Accuracy and Your Duty to Check

Generative AI is probabilistic. Output may differ from your product in colour, texture, pattern, stitching, stone count, fit or other details, and accessories may be altered or omitted. You must review every image before you publish it, sell from it, or otherwise rely on it, and you are responsible for ensuring that any image you publish accurately represents the product you are selling. Photta is a production tool, not a substitute for that check.

11. Third-Party Claims Arising From Your Content

If someone brings a claim against us because of content you uploaded, content you published, or your use of the Service in breach of these Terms, you agree to cover our resulting losses and reasonable legal costs. We will tell you promptly about any such claim, will not settle it without your agreement where that agreement affects you, and will let you take over the defence if you wish. This does not apply to claims caused by our own breach of these Terms.

12. Reporting Content and Removal

If you believe content on Photta infringes your rights — including a photograph of you used without permission — you can tell us using the report form, which requires no account. We review every report, remove content that infringes rights, and keep a record of each report and the action taken. Accounts that repeatedly infringe are terminated. We may also remove content and suspend access where we believe these Terms have been broken, without waiting for a report.

13. AI-Generated Content and Disclosure

Everything Photta produces is generated or modified by artificial intelligence. Where you publish output that depicts a person or that could be mistaken for a photograph of real events, you are responsible for making any disclosure your jurisdiction requires. We mark our output as AI-generated where we are required to do so and where the format allows.
